Congratulations, and thank you for purchasing MRW Publishing Products and/or Services.

This document advises the Terms and Conditions of your contract with MRW Publishing to include Supported Self-Publishing, Distribution and Amazon.

Supported Self-Publishing

Responsibilities of you, the Author

You, the client acknowledges that MRW Publishing is a publishing provider, and not a publisher, the difference being that a book publisher pays a royalty to the author.

You the client confirm that you have a full understanding of the responsibilities and legal requirements of a self-published author and that you are the author of the works submitted to MRW Publishing.

MRW Publishing takes no responsibility for the nature of the material supplied by you the client, and cannot be held liable for any action, suit, claim or demand brought by any person in respect thereof.

You the client confirm you own all copyrights to the work being submitted and have the power and ownership of the necessary permissions required to use the said works including any images, photographs, quotes, characteristics, story, and anything else that may hold copyrights, and understands that MRW Publishing is not liable in any way if these claims prove to be false.

You the client accept full responsibility for the content of the work submitted, whether, with regard to defamation, plagiarism or any other claim being made by a third party and you indemnify MRW Publishing in relation to any such claims.

MRW Publishing retains the right to reject any work that is inappropriate or offensive. This includes but is not limited to work containing pornography, extreme violence or anything discriminatory that could be construed as racist in nature.

MRW Publishing cannot be held responsible in any way for the result of any poor-quality materials supplied by the client for layout/typesetting. Examples include but are not limited to unedited written material, low-resolution pixelated and low-quality images, photographs, and illustrations.

You the client accepts that it is their sole responsibility to sign off on the manuscript before it is accepted for the first phase of publication, being typesetting/layout.

Typesetting/Layout

You the client acknowledge that all titles submitted to MRW Publishing for typesetting and layout design are complete and edited to the client’s satisfaction and that MRW Publishing cannot be held responsible for any errors occurring as a result of the client’s failure to check the content prior to issuing approval to proceed.

You the client acknowledge that they are responsible for ensuring that files are non-corrupt and error-free when supplied to MRW Publishing for typesetting and layout design.

If errors and inconsistencies (for example, indentations/spacing etc) are found, MRW Publishing retains the right to return the files to the client. And the client understands that it is their responsibility to resubmit files with all errors and corruptions removed.

You the client understand that any editing or proofreading required after the typesetting is complete will be charged at the current hourly rate of $50 per hour (plus GST), with a minimum charge of one hour.

• You the client understand that once the sample pages have been approved, the sample layout will be used as a template for the layout of the rest of the book and that any changes requested to the layout after the first draft approval has been accepted by the client, will be charged at the current hourly rate of $50 per hour (plus GST) with a minimum charge of one hour.
  
  
• You the client also acknowledge that any unforeseen editing requirements that are identified after work has commenced on the layout, in the form of previously missed typos or errors, changes to the text, etc, will incur an extra cost. These costs will be charged at the current hourly rate of $50 per hour (plus GST) with a minimum charge of one hour.
  
  
• You the client understand that MRW Publishing will provide you with access to a shared Google Drive folder to upload your manuscript.
  
  
• You the client understand that a single Word Document must be uploaded to your shared folder.
  
  
• You the Co-Author understand that you are required to have your completed and approved FINAL manuscript uploaded in SIXTY Days (60 days) in preparation for uploading for publishing.
  
  
• It is the responsibility of you the client to back up your files on your computer
  
  
• You the client understand that a single PDF sample manuscript will be created and sent to you as an email attachment for your approval. Any requests for formatting changes such as headings, fonts, margins and spacings are to be made at this time.

You the client understand that once the works are complete, they will be provided with a PDF print-ready, and eBook conversion-ready files (where applicable). Clients are asked at this time to check all works one last time before granting permission to proceed to the distribution phase.

You the client understand that once you grant permission to proceed, you are acknowledging that you have thoroughly checked the files and have given MRW Publishing authority to submit the files to the printers and/or distribution channels on you the client’s behalf and that MRW & SDH Publishing can take no responsibility or liability for any errors that may be in place after you the client’s permission to proceed has been given.

Book Cover Design

You the client acknowledge that all print book cover designs included in your package prices are basic cover designs, and will include the following:

• front cover
• back cover
• spine
• ISBN barcode and bar code (where applicable)
  up to two stock photographs/images or illustrations (to create a composite design)

If you the client opt to use your own photographs/images or illustrations, you must provide EVIDENCE of ownership via a signed Statutory Declaration.

MRW Publishing requires that you use ADOBE IMAGE/S license/s. You are required to send us a copy of the License/s.

You the client understand that if you supply your own COVER photographs/images or illustrations to be used in the cover design, they must be of a high resolution (72 DPI minimum to 600 DPI maximum) and all copyright permissions (if images are not owned by the client) must be in place.

You the client acknowledge the basic cover designs are created using royalty-free stock images, blended, and manipulated to create a composite image as close as possible to the client’s requirements. You the client understand that original illustrations and graphic designs can be supplied on request and will be priced upon approval.

You the client understand that where an eBook cover is also required, the print cover will be adapted for use with the eBook (front only) to match the print version.

Images Supplied by MRW Publishing

You the client understand that all images including photographs, illustrations and graphics supplied by MRW Publishing are restricted to the use of the client exclusively and may not be resold or given away for use by a third party/s.

You the client acknowledge you do not own the copyright or the work, but you are being granted a non-exclusive, perpetual, worldwide non-sublicensable, non-transferable license to use, reproduce, modify, or display the work. By way of example, you the client may use, display or modify the work in connection with the following:

• Business and commercial purposes
• Educational uses
• Personal uses
• Print and digital media such as magazines and newsletters
• Websites or Blogs
• Podcasts
• Advertising

You the client understand that MRW Publishing will not be held liable in any form or manner if you the client do not adhere to the Terms and Conditions of use in the MRW Publishing CONTRACT and that you indemnify MRW Publishing with regard to copyright violations due to the client’s misinterpretation or misunderstanding of the Australian Copyright Act 1968 Federal Register of Legislation applicable at any given time.

ISBNs

Co-Authors

You the client acknowledge that MRW Publishing owns the copyright of each co-author book and the listings on Amazon Kindle Direct Publishing KDP and all other book seller platforms.

• Co-Author books are sold through MRW Publishing.
  
  
• Proceeds of sales of Co-Author books will be distributed at a ratio of 20% investment to the Not For Profit NFP company Outback College of Rural Education OCRE to sponsor Australian outback children in educational opportunities they’re unable to access in their local geographical location. The remaining 80% will be distributed to MRW Publishing to manage, maintain and market the Co-Author books.
  
  
• Proceeds of sales of all Women Veterans Australia Co-Author books will be distributed at a ratio of 20% investment to the Women Veterans Australia Board and 30% to the NOT FOR PROFIT company Outback College of Rural Education OCRE to sponsor Australian outback children in opportunities they’re unable to access in their local geographical location. The remaining 50% will be distributed to MRW Publishing to manage, maintain and market the Co-Author books.
  
  
• Proceeds of sales will be distributed at a ratio of investment attributed to MRW Publishing’s ongoing administration, maintenance, marketing and legal costs.

Self-Publishing Authors

You the client acknowledge that you will open an account in your (the client’s) name with Thorpe and Bowker (the ISBN agency). You the client understand that it is your responsibility to ensure that all information supplied to MRW Publishing and all registrations are accurate and correct and that you will receive your own login details and provide a password to MRW Publishing in order to publish your book and upon completion will be returned to you the client in order to future manage your account which will be undertaken by you the client.

Prepublication Data Service (Formerly Catalogue-In-Publication [CiP])

You the client acknowledge that one (print and eBook) publication data service registration (formally CiP registration) with the National Library of Australia is included in their package.

Legal Deposit

You the client understand that it is your responsibility to meet the legal deposit requirements of the client’s national and state libraries for both print and eBooks.

Printing

Co-Authors

You the client acknowledge that where you have supplied final print-ready PDFs for printing eg. when these files have not been created by MRW Publishing, it is your responsibility to supply the files in the correct format as per the following specifications:

• Two high-resolution print-ready PDF files (300 DPI minimum to 600 DPI maximum) – one for the cover and one for the book interior.
  
  
• Double spread cover incorporating front, back and spine, and all necessary images and text (design) with barcodes, etc, included.
  
  
• Spine thickness is calculated on the correct width to match the page count and stock used.
  
  
• All images to be CMYK (for colour) and greyscale (for black and white) cover and interior (where applicable).
  
  
• All fonts to be embedded in the cover and interior (where appropriate).
  
  
• Interior file to be in single pages with 3mm bleed to top, bottom, and outside edges.

You the client understand that MRW Publishing cannot be held responsible or liable in any way or form if there are errors or issues with the quality of the files being supplied by the client.

You the client acknowledge that once the layout of the manuscript is complete, they will be provided with a final PDF proof for checking before it is sent to the printer.

You the client acknowledge that once they have given permission to proceed, they are acknowledging that they have thoroughly checked the files and that MRW Publishing can take no responsibility or liability for any errors that may have been overlooked.

You the Client understand that files will not be released until full payment has been received by MRW Publishing.

You the client acknowledge that once files have been submitted for print, a reset-up fee of $100 plus GST will apply if further changes need to be made.

Self-Publishing Authors

You the client acknowledge that you will receive a hard proof copy before final printing.

You the client acknowledge that in the event of an advanced physical proof copy of the book being required, you will be charged for set up, printing and shipping costs. The client understands that an advance proof copy is a mock-up only of the finished book and that it is designed to give them an idea of the overall design of their book.

You the client acknowledge that if changes need to be made to the layout and design after the proof has been printed, a print re set-up fee of $100 plus GST will apply.

You the client understand that slight colour and print variations may sometimes occur during the printing and that MRW Publishing cannot be held responsible for any said colour variations that may occur.

You the client acknowledge that in some rare instances, atmospheric pressures can affect pages and covers of certain types of books causing a degree of curling and that MRW Publishing cannot be held responsible for any issues due to high humidity, hot, cold, or damp conditions.

You the client acknowledge that all timeframes for printing and delivery quoted by MRW Publishing are approximations only and that MRW Publishing cannot be held responsible for any delays that may occur due to printing holdups and or delivery issues of any kind.

You the client understand that in the unlikely event that any errors or damage occur during the print or delivery process, they must be brought to the attention of
MRW Publishing within 21 days of the client receiving their shipment of books.
NB: Any claims lodged after this time may be rejected.

eBooks

You the client understand that the eBook format is available through MRW Publishing for distribution to eBook distributors and/or for sale via the client’s website.

Co-Authors

For Co-Authors, the client acknowledges you will receive a PDF copy of your Co-Author Chapter eBook.

You the client acknowledge that once the works are complete, you will be provided with final proofs for checking prior to issuing MRW Publishing with permission to proceed.

You the client understand that once they have issued the permission to proceed, you are acknowledging that they have thoroughly checked the files and that MRW & SDH Publishing can take no responsibility or liability for any errors that may exist.

Self-Publishing Authors

You the client acknowledge that once the eBook conversion process is complete, any editing or other changes that are required will incur a cost of $50 plus GST per hour for each hour spent in making said changes, with a minimum cost of one hour.

You the client also understand that files cannot be released until all outstanding monies owing to MRW Publishing are paid.

Timeframes

You the client acknowledge that any timeframes given in relation to the completion of jobs are estimates only, and at times may vary depending on the amount of work in the system, or unforeseen circumstances that may occur.

You the client also acknowledge that jobs are allocated in order of permission to proceed and payment of monies owing being received.

Online Global Distribution Books (Print On Demand) and eBooks

You the client understand that an account will be set up with the Ingram Content Group (book distribution) on their behalf by MRW Publishing, and their print books and eBooks will be distributed through Ingram’s distribution channels. You the client also understand that MRW Publishing has no control over future changes of policy that the said distributors may implement.

You the client understand that online bookstores’ policies may differ from store to store and that MRW Publishing has no influence or control over the bookstores’ policies regarding timeframes or the way titles are displayed.

You the client acknowledges that although their titles will be submitted to the distribution channels, bookstores will retain the right to list their title at their discretion and may, in certain circumstances choose not to list certain titles without explanation. If this should occur, MRW Publishing cannot be held liable in any way.

You the client acknowledge that payment of the first annual Print On Demand (POD) fee of $50 plus GST is included in the publishing package, and that it is the client’s responsibility to maintain the annual fees beyond the first year. If the client fails to maintain the annual listing fees, the client acknowledges that listings will be removed from all distribution channels.

You the client understands that online bookstores may use third-party sellers
to sell titles, and in some cases purchase small amounts of stock and resell second-hand copies of titles.

You the client understand that you will be responsible for the ongoing management of your Ingram Content Group account.

Online Sales Books (POD) and eBooks

Co-Authors

You the client will receive your own personal chapter eBook with the Front and Back (if applicable) covers to use as a giveaway, LEAD MAGNET to prospective clients with the link provided in the eBook to take the reader to the AMAZON listing of your Co-Author Book.

Self-Publishing Authors

You the client understands that an account will be set up with Amazon on their behalf by MRW Publishing, and that MRW Publishing has no control over future changes of policy that Amazon may implement, and no control over the timeframes or the way titles are displayed. You the client understand that you will be responsible for the ongoing management of your account with Amazon.

Return on Investment or Financial Success

MRW Publishing cannot guarantee any financial success from any of our products and services. We do not guarantee any income, success, or any return on investment from any of our products and services. You acknowledge that your earning potential is subject to many factors, all of which vary from individual to individual and are often out of any individual’s control. We do not offer any form of warranty or guarantee that you will receive any level of earnings by purchasing or using any products or services that we offer.
